Initial assessment and separation advice

Two ways to start a separation with PK Law, each with a fixed fee.

Two ways to start.

Most people come to us for one of two reasons. Some want us to act for them and see the separation through to a signed agreement. Others want detailed advice they can take forward themselves. Each has its own starting point.

Initial separation assessment.

The starting point for clients who want us to act on their separation. The assessment establishes what your matter involves and what it will take to resolve, so you know the work and the cost before you commit to anything further.

Our questionnaire

Before we meet, you complete a questionnaire setting out your assets, debts and circumstances.

A meeting with us

We go through your situation, identify the issues that will shape the outcome, including any trust, business or property overseas, and explain where you broadly stand.

A recommended package

We recommend the package of work your matter needs, from negotiation through to a signed agreement and the transfer of assets.

A fixed quote in writing

Afterwards you receive a short written summary of the issues and the recommended package, with a fixed fee for it.

If a trust is involved

The assessment fee is the same whether or not a trust is involved. Where there is a trust, the work it requires is scoped and priced in your package.

Separation advice.

For people who want detailed advice to take forward themselves: to negotiate directly with a former partner, to test a proposal before accepting it, or to understand their position before deciding how to proceed.

A detailed calculation

What is likely to be relationship property and what is likely to be separate, and what each of you may be entitled to.

Your options for dividing it

The realistic options for the family home, KiwiSaver, savings and other assets, and what each would mean for you.

A negotiation strategy

What to propose, where to hold firm, and the points at which agreeing would put you at risk.

The early conversations

How to raise property matters with your former partner, what to say, and what to avoid agreeing to.

A follow-up call

Once you have considered the advice, a follow-up call to answer your questions.

$3,500 + GST

$2,350 + GST

Where a trust claim or cross-border issues are involved.

When this fee applies

This fee applies where the advice turns on a claim relating to trust property, or on property or circumstances in more than one country. A family trust that simply holds assets does not, by itself, bring advice into this fee.

From $5,500 + GST

Trust claims

Where there is a trust claim, we review the trust deed and the history of what went into the trust and when, and advise on the claims available to you, how strong they are and how to pursue them.

Cross-border issues

Where there are cross-border issues, we advise on how property in another country is treated and how an agreement can be given effect there.

An agreement dividing relationship property is binding only if each of you has independent legal advice and certification before signing. When you reach agreement, we can provide that advice and certification for you.
